Obraz stosunków Księstwa Smoleńskiego z miastami hanzeatyckimi na podstawie umów handlowych

dc.abstract.en	The work is devoted to relations between the Smolensk Principality and Hanseatic cities, primarily Riga and Visby. Relations between these entities are reconstructed on the basis of two trade agreements: the contract of Mstislav Davidovich in 1229 and the contract of an unknown Smolensk prince. The first chapter briefly describes the most important information about the Smolensk Principality, its history and trade relations. The history of the establishment of the Hanseatic League and its early expansion into Ruthenia is also presented. The second chapter is devoted to the analyzed texts. The contract of Mstislav Davidovich is preserved in six copies grouped into two redactions: Rigan and Gotlandic. Different concepts of their dating were analyzed, resulting in a conclusion about the seniority of the Riga redaction. The contract of an unknown prince, the dating of which was also disputed, was considered to have been created during the reign of Svyatoslav Mstislavich in Smolensk. The third chapter deals with the legal characteristics of the agreements. Their parties and scopes: subject, place, time and object are defined. The fourth chapter analyzes the content of the two agreements with a particular focus on the provisions reflecting the Smolensk-Hanseatic relations of the time. The Smolensk-German treaties officially guaranteed full equality of rights between Ruthenians and Germans. Nevertheless, their provisions were much better suited to a situation in which it was a German merchant who traded in Smolensk, not a Ruthenian in Riga and Visby. The Smolensk-German agreements also allow us to observe many of the general aspirations of Hanseatic merchants in foreign trade. In addition, this chapter discusses the differences between the redactions of the Mstislav Davidovich agreement, as well as between the said agreement and that of the unknown prince.
dc.abstract.pl	Praca jest poświęcona stosunkom między Księstwem Smoleńskim a miastami hanzeatyckimi, przede wszystkim Rygą i Visby. Relacje między tymi podmiotami są rekonstruowane na podstawie dwóch umów handlowych: umowy Mścisława Dawidowicza z 1229 r. i umowy nieznanego smoleńskiego kniazia. W pierwszym rozdziale są krótko opisane najważniejsze informacje o Księstwie Smoleńskim, jego historii i stosunkach handlowych. Przedstawiona została także historia powstania Hanzy i jej wczesna ekspansja na Ruś. Drugi rozdział jest poświęcony analizowanym tekstom. Umowa Mścisława Dawidowicza zachowała się w sześciu odpisach pogrupowanych w dwie redakcje: ryską i gotlandzką. Przeanalizowane zostały różne koncepcje ich datowania, w wyniku czego sformułowany został wniosek o starszeństwie redakcji ryskiej. Umowa nieznanego kniazia, której datowanie także było sporne, została uznana za powstałą za panowania w Smoleńsku Światosława Mścisławicza. Rozdział trzeci dotyczy charakterystyki prawnej umów. Określone zostały ich strony i zakresy: podmiotowy, miejscowy, czasowy i przedmiotowy. W rozdziale czwartym przeprowadzona została analiza treści obu umów ze szczególnym uwzględnieniem postanowień odzwierciedlających panujące ówcześnie stosunki smoleńsko-hanzeatyckie. W traktatach smoleńsko-niemieckich została oficjalnie zagwarantowana pełna równość praw Rusinów i Niemców. Mimo to, ich postanowienia były znacznie lepiej przystosowane do sytuacji, w której to niemiecki kupiec handlował w Smoleńsku, a nie ruski w Rydze i Visby. Umowy smoleńsko-niemieckie pozwalają także zaobserwować wiele spośród ogólnych dążeń kupców hanzeatyckich w zagranicznym handlu. W tym rozdziale zostały ponadto omówione różnice między redakcjami umowy Mścisława Dawidowicza, a także między rzeczoną umową a umową nieznanego kniazia.
