The challenges of holding non-state actors responsible for crimes in international law: case study of ISIS human rights abuses of the Yazidi Woman
| dc.abstract.en | As the primary entities of the international legal system, states have certain roles and responsibilities when it comes to respecting other states’ sovereignties and maintaining peace and cooperation among entities. The international legal system was built primarily to hold states accountable. Therefore, in regards to the legality of the actions carried out by other entities such as non-state actors, there is a question of how to hold these actors accountable for their criminal acts, in a legal system that does not contain the mechanisms to do so. The Yazidi people are an ethnic and religious minority mainly located in Iraq and parts of Syria who have been terrorized and mistreated by ISIS; a non-state actor. Because of the lack of statehood status, ISIS has not been held accountable for its crimes committed against the Yazidi people, meaning that the international system has failed to bring justice to the victims affected by the atrocities committed against them simply for being minorities. This thesis aims to highlight the existing mechanisms in the international legal system and the challenges that arise with efforts to utilize said mechanisms to hold non-state actors such as ISIS accountable. |
