Działalność kuratora spadku w postępowaniu cywilnym

dc.abstract.en	The author describes the issues surrounding the institution of estate administration in Poland, with particular emphasis on the legal status of the estate administrator and their standing in various proceedings, and offers views on how to improve the functioning of this institution within the Polish legal system. First, the author traces the evolution of views on the legal status of the estate administrator, particularly the conflict between the positions advocating representation versus indirect substitution, against the backdrop of doctrinal disputes and the evolution of Supreme Court case law. Next, it explains the functioning and activities of the estate curator and presents examples of permitted actions, supplementing this with certain key substantive legal considerations regarding inheritance in general. It also explains the role and status of the estate curator in civil proceedings, tracing the case law that grants the curator standing in specific proceedings. Finally, the author formulates his own views and draws conclusions de lege ferenda aimed at improving the functioning of this institution within the Polish legal system.
dc.abstract.pl	Autor opisuje problematykę instytucji kurateli spadku w Polsce, ze szczególnym uwzględnieniem pozycji prawnej kuratora, legitymacji w poszczególnych postępowaniach, oraz formułuje poglądy dotyczące poprawy funkcjonowanie tej instytucji w polskim porządku prawnym. W pierwszej kolejności śledzi ewolucję poglądów na temat pozycji prawnej, w szczególności konflikt stanowiska opowiadającego się za przedstawicielstwem lub zastępstwem pośrednim, na tle sporów doktrynalnych i ewolucji orzecznictwa Sądu Najwyższego. Następnie przybliża funkcjonowanie i działalność kuratora spadku oraz prezentuje przykładowe dozwolone czynności, uzupełniając to pewnymi kluczowymi rozważaniami materialnoprawnymi, na temat spadku w ogóle. Przybliża także rolę i pozycję kuratora spadku w postępowaniu cywilnym, śledząc orzecznictwo przyznające kuratorowi legitymację w poszczególnych postępowaniach. Wreszcie, formułuje własne poglądy i wyprowadza wnioski de lege ferenda, zmierzające do poprawy funkcjonowania tej instytucji w polskim porządku prawnym.
