Anonimowość pozwanego – aktualnie dostępne środki prawne oraz postulat wprowadzenia ślepego pozwu do Kodeksu postępowania cywilnego
| dc.abstract.en | The subject of the dissertation is the issue of the defendant’s anonymity. Defendant’s anonymity occurs when a person who allegedly has a claim against another person and wants to pursue it in court does not know the identifying information of the defendant. The dissertation analyzes the effects of the defendant's anonymity on the plaintiff's legal position and the legal means available to the plaintiff to assert liability against a person other than the anonymous defendant or to learn the identifying information of the anonymous defendant (called the direct perpetrator). Then, in connection with confirmation of the hypothesis that the legal remedies available in Polish law are insufficient in this regard, the dissertation examines John Doe lawsuit available in US procedural law. John Doe is a legal mean that allows a lawsuit to be filed against a person whose identity is initially unknown, and whose identifying information –after the statement of claim has already been filed – is established by the plaintiff with the assistance of the court. This is followed by a comprehensive discussion of the de lege ferenda postulate for the implementation of a similar institution to the John Doe lawsuit – known as a "blind lawsuit" (“ślepy pozew”) – into the Polish legal system. |

Anonimowość pozwanego zachodzi wówczas, że osoba, która twierdzi, iż przysługuje jej roszczenie wobec drugiej osoby i chce dochodzić go przed sądem, nie zna danych identyfikujących adresata owego roszczenia. W pracy analizie zostają poddane skutki anonimowości pozwanego dla sytuacji prawnej powoda oraz środki prawne dostępne powodowi w celu dochodzenia odpowiedzialności od innej osoby niż anonimowy pozwany lub poznania danych identyfikujących anonimowego pozwanego (nazywanego bezpośrednim sprawcą). Następnie w związku z potwierdzeniem hipotezy, że wskazane powyżej środki prawne dostępne w prawie polskim są w tym zakresie niewystarczające, badany jest John Doe lawsuit stosowany w prawie procesowym Stanów Zjednoczonych. John Doe to instytucja umożliwiająca wniesienie pozwu przeciwko osobie początkowo nieznanej co do tożsamości, której dane identyfikujące – już po wniesieniu pozwu – zostają ustalone przez powoda przy pomocy sądu. Następnie kompleksowo zostaje omówiony postulat de lege ferenda wprowadzenia podobnej instytucji do John Doe lawsuit – zwanej„ślepym pozwem” – do polskiego porządku prawnego. |
